What is a trademark search?
A trademark search checks whether another business may already be using a name, logo, or slogan that could conflict with yours. Our initial baseline search looks for readily apparent conflicts before filing. Our comprehensive search looks more broadly, including beyond federal trademark filings. The comprehensive search also comes with a written attorney opinion explaining what we found, potential risks, and whether we recommend filing. No search can guarantee that every possible conflict will be found.
What is an office action?
An office action is an official letter from the USPTO about your trademark application. The examiner may ask for more information, require a change, or explain a reason the mark may not qualify for registration. It does not always mean the application is over, but it usually requires a response by a deadline. Responses to examiner office actions on the covered application are INCLUDED in Signature; they are quoted separately under Essential.
Can hiring an attorney make the process faster?
An attorney cannot promise faster USPTO review. Careful preparation can help avoid preventable mistakes and delays. With Signature, we also monitor your application and handle covered USPTO responses, so you have legal support throughout the process and help avoiding unnecessary delays along the way.
How long does it usually take to obtain federal trademark protection?
If you mean federal trademark registration, the process often takes 12–18 months from filing, and some applications take longer. Even an application with few or no issues must go through USPTO review and a publication period. Requests for corrections, objections, or additional filings can extend the timeline. With Signature, we remain your attorney throughout the covered application process, monitoring its progress and handling covered USPTO responses.
What does the Signature package’s 100% money-back guarantee cover?
If we recommend filing your mark, file the covered application, and it ultimately cannot be registered after the covered examination process, we refund 100% of the attorney fee allocated to filing and covered representation, subject to the written agreement. This is not a refund of the full $3,500 package price. The fee for the completed comprehensive search and written opinion and amounts paid to the USPTO are excluded. The agreement explains the conditions, including client cooperation and what happens if an application covering two classes registers in only one.
What is the USPTO?
USPTO stands for the United States Patent and Trademark Office. It is the federal agency that reviews applications and registers U.S. trademarks. Its filing fees are separate from attorney fees unless your package expressly includes them.
What are classes within the USPTO?
Classes are the categories the USPTO uses to organize products and services in a trademark application. For example, printed books and educational services may fall into different classes. The categories that fit your business depend on what you actually offer or plan to offer under the mark. The USPTO currently charges a base application fee of $350 per class when the application meets its base-fee requirements.
